(END USER LICENSING AGREEMENT)

This End User Licensing Agreement (EULA) is a legal agreement between you (“Licensee”) and Peachcreme branding and becomes a binding contract between you and Peachcreme branding when you click on the area marked “ACCEPT LICENSE AGREEMENT” or similar language, or when you accept the EULA by other means (for instance referring to the EULA in a purchase order, a confirmation email, etc.). Please read this entire document before purchasing, downloading, or using the font software (“Font”). If you do not wish to be bound by the Agreement, you cannot purchase, download, or use the Font.

To enter into this EULA, you must be eighteen (18) years of age or older, and be able to form binding contracts under the laws applicable to you. By completing your purchase and installing the Font, you are representing and warranting that terms mentioned in this EULA are correct. This EULA applies to all Fonts offered by Peachcreme Branding, whether the Font is offered free of charge or offered for sale. Peachcreme Branding provides various font licenses. After purchasing a font with a specific license, the EULA will automatically come into effect in accordance with the terms of that particular license. For example, if you bought a font with a desktop license, then from the moment of purchase the license agreement based on the terms specified in the desktop license will be valid.

YOU HEREBY AGREE TO THE FOLLOWING:

Binding Agreement: You are bound by this EULA and you acknowledge that all use of Fonts offered by Peachcreme branding is governed by the EULA.

License Grant: You are hereby granted a non-exclusive, worldwide, perpetual, non-assignable, and non-transferable (except as expressly permitted herein) license to install, access, and use the Font only subject to all of the terms and conditions of this EULA. Peachcreme branding reserves all rights not expressly granted to Licensee in this EULA. If you have any doubts as to whether a particular use of this Font is permitted or prohibited by this EULA, please contact us by emailing hello@peachcreme.com for more information.

YOU CAN:

• Install the font(s) on 1 computer;
• Design/Create products (ONLY in the rasterized image or vector outline form) such as invitations, business cards, logos, branding, greeting cards, marketing materials, packaging designs, images on websites, apparel, books, stationery, etc.;
• Use the font(s) to create physical items for sale. Up to 10.000 sales;
• Use the font(s) for Personal and Commercial Projects ONLY if the end product(s) are in rasterized image or vector outline form;

YOU CANNOT:

• Embed in websites, web apps; broadcast Content: TV, Motion, Video, Movies, Cartoon; in electronic books/readers/devices; all gaming uses and/or devices; softwares like Templett, Corjl, Canva, etc.
• “Embedding” means the font file is included in the electronic document, app, or other files, as opposed to a static graphic (raster or bit-mapped) representation;
• Resale/Sublicense the font in source file form or otherwise competitive with the font;
• Claim the font as your own creation;
• Distribute the Font Software with client proofs, templates, or in un-flattened files;
• Use in Design or Print-on-Demand applications;
• Allow your customers to individually personalize or customize their own physical goods for resale;
• Use alphabet or letterform-related products for resale or letterform creation products or devices;
• Obtain the Font Software illegally (i.e. peer sharing, renting, downloading/accessing via a link/website not affiliated to Peachcreme and/or not paid for the EULA);

INAPPROPRIATE USE:

Licensee may not use the Font in pornographic, fraudulent, immoral, infringing, illegal, harassing, offensive, or defamatory material, including, without limitation, any use of the Licensed Asset that:

• may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal;
• may create a risk of any other loss or damage to any person or property;
• seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise;
• may constitute or contribute to a crime or tort;
• contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable;
• contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party's trade secrets);
• contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
• contains any information or content that you know is not correct and current; or
• promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.

COPYRIGHT:

The Font is protected by copyright law. Peachcreme Branding is the sole, exclusive owner of all intellectual property rights, including rights under copyright and trademark law. Licensee agrees not to use the Font in any manner that infringes the intellectual property rights of Peachcreme Branding or violates the terms of this EULA.

TERMINATION:

This EULA is effective until terminated. Any breach of the stated in this EULA terms shall be cause for termination of this License Agreement. In the event of termination, and without limitation of any remedies under law and equity, you agree to immediately remove the font and certify that no copy remains in your possession or control. Compensation will be required for the damage caused to Peachcreme branding.

AMENDMENTS:

Peachcreme Branding reserves the right to make amendments to this agreement at anytime and without notice. It is the Licensee's responsibility to ensure that they check the EULA periodically to ensure that their usage of the Font Software is still compliant with this EULA. This agreement may only be modified by an authorised appointee on behalf of Peachcreme Branding.

REFUND POLICY:

All purchases are final. Due to the nature of digital goods, Peachcreme Branding does not offer any refunds or exchanges on Font purchases. Please place your order carefully.
